Terms and conditions of sale

The terms that apply to purchases in the Divinol online shop.

1General provisions

These terms govern purchases in the Divinol online shop (divinol.lv and divinol.ee).

By placing an order the buyer confirms that they have read and accept these terms. The buyer may be a consumer (natural person) or a legal entity. Terms that apply only to businesses are set out in a separate section.

2Orders and conclusion of the contract

Products are selected by adding them to the shopping cart and completing the checkout. Before confirming the order the buyer can review and correct the entered data.

After placing the order the buyer receives a confirmation at the email address provided. The distance contract is concluded when the seller confirms the order.

If an ordered product cannot be supplied (e.g. it is unavailable from the manufacturer), the seller will inform the buyer without delay and offer an alternative or refund the amount paid within 14 days at the latest.

3Prices

Prices are in euros (EUR). Private customers see prices including value added tax (VAT) at the rate of the selected delivery country. Approved B2B customers see prices excluding VAT with their individual discount applied.

Delivery costs are shown before the order is confirmed. The freight price for large packs is confirmed individually by the seller before the order is fulfilled.

If a price is displayed incorrectly due to an obvious technical error, the seller will inform the buyer, who may either confirm the order at the correct price or cancel it.

4Payment

Available payment methods:

  • payment card (Visa, Mastercard) and payment services offered at checkout;
  • bank transfer against a prepayment invoice;
  • payment by invoice — for approved B2B customers only.

A prepayment invoice must be paid within the term stated on it. The order is processed once payment is received. Card payments are processed by a certified payment service provider; the seller never sees or stores card details.

5Delivery

Products are delivered in Latvia, Estonia and Lithuania by parcel locker, courier or freight carrier, or can be collected at our Riga warehouse. Delivery options, prices and free delivery conditions are listed on the “Delivery and payment” page.

The delivery time is stated in the order confirmation. If no time is stated, the seller delivers the goods within 30 days of the conclusion of the contract at the latest.

The risk of accidental loss of or damage to the goods passes to the buyer when the buyer or a person designated by the buyer takes possession of the goods. Please check the packaging on receipt and inform the seller of any damage without delay.

6Right of withdrawal (14 days)

A consumer has the right to withdraw from the distance contract within 14 days without giving any reason. The withdrawal period starts on the day the consumer or a person designated by the consumer receives the goods.

To exercise the right of withdrawal, the consumer must send the seller a clear statement to elama@elama.lv before the period expires, stating the order number, the products and a bank account for the refund. The model withdrawal form annexed to Cabinet Regulation No. 255 “Regulations on Distance Contracts” may also be used.

The consumer must return the goods without undue delay and no later than 14 days after sending the withdrawal notice. The direct cost of returning the goods is borne by the consumer unless agreed otherwise.

The seller refunds all payments received, including standard delivery costs, no later than 14 days after receiving the withdrawal notice, using the same means of payment. The seller may withhold the refund until the goods have been received back.

The consumer is liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature and characteristics — for example if the package has been opened and part of the product used.

7Conformity of goods and complaints

The seller is responsible for the conformity of the goods with the contract. A consumer may submit a claim regarding non-conforming goods within two years of receiving the goods in accordance with the Latvian Consumer Rights Protection Law.

Claims must be submitted in writing to elama@elama.lv, together with proof of purchase and, if possible, photos. The seller will respond to the claim within 15 days.

The seller is not liable for damage caused by using a product contrary to the equipment manufacturer's requirements, the product description or the safety data sheet, or by improper storage.

8Terms for businesses (B2B)

The consumer right of withdrawal does not apply to purchases made by legal entities or by natural persons in the course of their business.

The B2B price level, discount and invoice payment term are granted by the seller after verifying the company's details. The seller may change or withdraw the option to pay by invoice if invoices are not paid on time.

On receipt the buyer must check the quantity of goods and the integrity of the packaging, and record obvious discrepancies on the delivery note or notify the seller without delay. For late payments the seller may charge statutory default interest in accordance with the Latvian Commercial Law.

9Liability

The seller is not liable for failure to perform contractual obligations due to force majeure. Product descriptions, oil finder recommendations and calculator results are for information only — check the equipment manufacturer's requirements before using a product.

Product images may differ slightly from the actual packaging if the manufacturer has changed the design.

10Personal data

The buyer's personal data is processed to fulfil the order and to comply with legal requirements in accordance with the Privacy Policy available on this website.

11Dispute resolution

Disputes are first resolved through negotiation between the seller and the buyer. If no agreement is reached, the consumer may contact the Consumer Rights Protection Centre of Latvia (PTAC, www.ptac.gov.lv) or the Consumer Dispute Resolution Commission.

In cross-border disputes the consumer may contact the European Consumer Centre Latvia (www.ecclatvia.lv). The European Commission's Online Dispute Resolution (ODR) platform ceased operating on 20 July 2025.

Disputes that cannot be settled by agreement are resolved by the courts of the Republic of Latvia in accordance with Latvian law.

12Final provisions

The seller may amend these terms. An order is governed by the terms in force at the time the order was placed. These terms are governed by the laws of the Republic of Latvia.
